WHO ARE THE PARTIES TO THE REPUTATION ACTIONS?
If the property is in the hands of the debtor at the time of foreclosure, the right to file a lawsuit belongs to the third party. The third person who can file a lawsuit here is the person claiming to have a right on the property. The property does not necessarily belong to the third party. For example, if the third party has the right of pledge on the property in question, this lawsuit can also be filed. A lawsuit is a lawsuit filed against a creditor. The creditor here is the creditor who puts a lien on the movable or immovable property whose entitlement is in dispute.
In some cases, there may be more than one creditor of the execution proceeding against the debtor. In the event that more than one creditor initiates enforcement proceedings and there is obligatory litigation between them, the lawsuit regarding the contentious property subject to seizure should be brought together against these creditors.
