WHEN WILL THE CASE BE CONSIDERED FILED
The law provides that the case shall be deemed to have been filed on the date of registration of the petition of claim (m.188/1) and regulated that the principles and procedures for the registration of the petition of claim will be determined by Regulation.
36 of the Regulation. Its article provides for various possibilities in this regard. Accordingly, the case is considered to have been filed on the date of filing and registering the petition of claim (in electronic form, in UYAP).
If for any reason it is not possible to conduct an electronic transaction (transfer); the transaction is made in a physical environment, this is determined by a record; when the electronic system is opened, transactions made in a physical environment are transferred to an electronic environment without delay, and in this case, the case is considered opened on the date of the issuance of this record.
If the case is filed with an electronic signature through the UYAP system and the trial fees and expenses are transferred electronically to the court teller’s account or provided by payment instruments such as barocart or credit card, the case is deemed to have been filed on the date the case petition is registered in the UYAP System.
