What is Probation?
Probation is a criminal law institution that enables the execution of a person’s sentence in social life during the trial period determined by the legislator. The perpetrator is observed through probation in social life thanks to this institution. The probation law is a law enacted with the aim of maintaining the ties with one’s social life, family and adapting to the outside world. While the convict is executing his sentence in prison, he is released after a certain period of time before his release on probation and is kept under social life outside.
Probation practice can be caused by many different reasons. For example, probation for drug use is a precautionary measure applied before a judgment is rendered against the person prosecuted. It is an institution that finds this and many other application areas.
Probation Act
The law known as the probation law actually refers to the regulations introduced by Article 105/A of the Penal Execution Law No. 5275. This law is known as the Probation Law. The reason why this law is called the probation law is that with an addition to the Penal Execution Law No. 5275, the convict who has committed many crimes was released from prison.
