THINGS TO KNOW ABOUT A NEGOTIATED DIVORCE
The concept of a negotiated divorce is enshrined in Article 166 of the Turkish Civil Code. article 3. it is arranged in paragraph. According to the article in question, the conditions established for an agreed divorce must be met.
First of all, it should be noted that in order to get an agreed divorce, the spouses must have been married for ez 1 year. Couples who have been married for less than a year must wait for the completion of a year before they can divorce by agreement. On the other hand, in an agreed divorce, as the name implies, the parties must fully agree, agree on all the material and moral legal consequences of the divorce and draw up a divorce protocol related to it. In the case of an agreed divorce filed, the parties must be present before the judge, and the conclusions in the submitted divorce protocol must be confirmed in front of the judge, to which both parties have given their consent. In cases where one of the parties does not appear before the judge, a divorce cannot be decided, and the agreed divorce case is postponed to the other hearing so that the party who does not come can be heard.
If there are children in the marriage union in question, the issue of custody is also important. The protocol drawn up in the negotiated divorce case should be drawn up in detail in such a way that there is no doubt in terms of custody.
The judge decides that the parties are in full agreement on the issues related to the material and moral consequences of the divorce specified in the divorce protocol, and if he decides that the divorce will be achieved in this way after his own assessment, he decides to divorce according to the issues agreed between the parties. As it can be understood, a negotiated divorce is a form of divorce that allows the parties to divorce as soon as possible.
