Mandatory Elements That Must Be Included in the Petition of Lawsuit
In Civil Courts, a lawsuit is filed by filing a lawsuit petition. According to the Code of Civil Procedure No. 6100, there are some mandatory elements that must be included in the petition to be written in order to file a lawsuit. These mandatory elements are regulated in Article 119 of the Code of Civil Procedure No. 6100. According to the aforementioned article;

ARTICLE 119- (1) The following matters are included in the petition:
a) The name of the court.
b) Names, surnames and addresses of the plaintiff and the defendant.
c) The applicant’s Republic of Turkey identification number.
ç) The names, surnames and addresses of the legal representatives of the parties and the attorney of the plaintiff, if any.
d) The value of the subject of the case in cases concerning the subject of the case and property rights.
e) Clear summaries of all the facts on which the claimant is based, under the serial number.
f) What evidence will be proven for each alleged fact.
g) Legal grounds based on.
ğ) Clearly as a result of the request.
h) The signature of the plaintiff, if any, of his legal representative or attorney.
(2) In case of missing points other than subparagraphs (a), (d), (e), (f) and (g) of the first paragraph, the judge gives the plaintiff a one-week deadline to complete the deficiency. If the deficiency is not completed within this period, the lawsuit is deemed not to have been filed.
