Legal Nature and Fulfillment of ECHR Decisions
The European Court of Human Rights is not a court above the national courts, that is, a court where an application is made by law. In other words; in national law, decisions made by courts are not a place of appeal. As a rule, the ECHR cannot overturn or correct the decisions of the national court. The ECTHR also does not have the authority to intervene directly with the contracting state in the decisions made in favor of the applicant in order to fulfill the requirement of the decision. On the other hand, both 90 of the Constitution. considering both the article and the obligations assumed by the contracting states, it is impossible that the decisions of the ECHR will not be fulfilled.
Payment of Compensation Ruled by the ECHR
The compensation determined in the ECHR decisions should be requested by a petition to be sent to the institution of the Human Rights Department under the Ministry of Justice after the decisions have been finalized. If requested, the compensation provided for shall be credited to the bank account specified by the applicant in his petition within three months.
