The Crime of Execution and Bankruptcy- Withdrawal from the Auction to Ensure the Benefit
In case of withdrawal from the auction for the purpose of providing benefits, the person who does not participate in the auction in exchange for the promise of providing benefits or benefits provided to him or someone else at auctions or who withdraws later from the auction shall be punished. In addition, intermediaries who contribute to this crime by mediating tenders will be punished in accordance with the same provision of the law.
In order for the offence of withdrawal from the auction to benefit to occur; there must be a tender made by the enforcement directorate and the defendant must have been provided or promised a benefit to participate in this tender or withdraw from the tender for enforcement offences.
The prosecution of the crime depends on the complaint and the complaint must have been filed by the creditor, debtor or related third parties.
The court in charge of these executive crimes is the Executive Criminal Court, and these cases cannot be combined with criminal cases in other courts. The court authorized in terms of the crime is the court to which the enforcement agency is attached, where enforcement proceedings are conducted.
