Article 83 – Traffic accidents;
a) To the local general constabulary, in order to take necessary action from the judicial side,
b) It is seized by the traffic police in order to determine the causes, traces and evidences of the accident and to draw up a traffic accident report.
In accidents that occur on the highways where the traffic police are not on duty or are not present, the traffic accident report is prepared by the local general municipal police and a copy is sent to the traffic police of that place.
In traffic accidents that occur on the highways and result in only material damage, if the parties agree and the act does not constitute another crime, no judicial prosecution is made and the provision of Article 565 of the Turkish Penal Code is not applied.
In cases where the road is closed to traffic in traffic accidents; traffic police or general police; It is authorized to open the road to traffic after marking the traces and evidence in a way that will not be lost and taking the necessary actions.
The closure of the highway to traffic was caused by fatal and life-threatening injuries, and this accident affects life, property and traffic safety and if it is understood that the public prosecutor will be delayed if another road cannot be passed, the road is closed to traffic after the necessary signs are made and the vehicle and dead people are taken aside and the situation is determined with a report. opens.
