WHAT DOES CONTROLLED FREEDOM MEAN?
The law is a criminal law institution that allows the execution of a person’s sentence in social life within the determined trial period. The perpetrator is observed through probation in social life.
The probation law is a law enacted on the grounds that a person can maintain ties with his family and adapt to the outside world. While the convict is executing his sentence in prison, he is released after a certain period of time before his release on probation, and is kept under surveillance in social life outside.
SUPERVISED FREEDOM TIME
The probation period was 2 years for crimes committed before 01.07.2016, and one year for crimes committed after this date. With the probation arrangement to be made now, a person will be able to spend 1/5 of the total punishment he received in the prison, and then spend the rest on probation, and the probation period will be limited to 3 years. In other words, probation will be extended to 3 years.
If we give an example of this situation;
A person who has been sentenced to 4 years will be sentenced to 3 years if the recidivism clause has been imposed, 58. Art. If not, he will spend 2 years and 8 months in prison. However, with the probation law, recurrent offenders will be able to be released on probation after spending approximately 216 days of their sentences, and 192 days without recidivism.
