SUBJECT : It is the submission of our authorization objection and our excuse statement.
DESCRIPTIONS :
In the case at hand, the competent court is Antalya courts in accordance with Article 168 of the TMK. For this reason, although we had filed an objection to authority before, our objection was not accepted by your court on the grounds that the plaintiff lived in Van.
However, in the hearing dated ../../2018, the plaintiff’s attorney declared that the plaintiff was with his sister in Antalya and requested an instruction to the Antalya courts, and in the statement dated …/../2018, “.. Mah… Sk … Apt. No:.. D:.. ../Antalya”. He even declared in his petition dated ../../2018 that the plaintiff had to return to Van due to condolences, and therefore he could not attend the instruction hearing held in Antalya.
As it is clearly understood from the statements of the plaintiff’s attorney, the plaintiff lives in Antalya. For this reason, we reiterate our objection to authorization and request that the file be sent to the authorized Antalya courts with a decision of lack of jurisdiction.
