Executive Offenses According to the Law on Enforcement and Bankruptcy
Enforcement offenses are regulated in the Enforcement and Bankruptcy Code. Creditors who cannot collect their receivables from the debtor have the right to collect their receivables by force with the help of the state. In order for the cebr-i execution regulated in the Enforcement and Bankruptcy Code to be effective, some obligations have also been imposed on the debtor in the law. If the debtor does not fulfill these obligations in the manner provided for in the law, sanctions have also been issued under the name of enforcement offenses.
The following are the enforcement offenses listed in the law, in order;
1- Reduction of Its Presence with the Intention of Bringing Its Creditor to a Loss (m. 331)
2- The One Who Caused the Pain by His Own Act or Intentionally Aggravates the Ills of His Situation (m. 332)
3-Providing Personal Benefits in Bankruptcy and Concordat Cases (m. 333)
4- Putting the Creditors into Harm’s Way by Not Paying the Debts of the Commercial Enterprise with the Intention of Causing the Creditors of Those Who Have the Management Authority in the Trading Companies to Be in Harm’s Way (m. 333/a)
5-Do not Mislead the Authorized Persons in the Concordat (m. 334)
6- The Goods on Which the Lessor Has a HapisHakki Must be Smuggled and Occupied by Someone Else in the Place Where They Need to Be Evicted (m. 335)
7-Not to Give the Mufli’s Property to the Bankruptcy Administration and Not to Report the Mufli’s Receivables (m. 336)
8- Non-Declaration of Goods (m. 337/1)
9-Failure to Deliver the Requested Goods, Not to be Present during the Bookkeeping Failure to Comply with the Orders of the Bankruptcy Administration (m. 337/2)
10- Violation of the Provisions on the Abandonment of Trade (m. 337/a)
11- Making a Statement Contrary to the Truth (m. 338)
12- Failure to Report an Increase in Goods and Earnings After the Declaration of Goods (m. 339)
13- Violation of the Obligation (m. 340)
14- Avoidance of Child Delivery (m. 341)
15- Re-Entry into the Immovable Property and Ship Delivered by the Decree (m. 342)
16- Opposition to the Execution of the Provisions of the Ilam (m. 343)
17- Non-Payment of Alimony Arrears (m. 344)
18- Failure to Request the Bankruptcy of the Capital Company If Necessary (m.345/a)
19- Withdrawal from the Auction for the Benefit (m.345/b)
